4. Third Party Terms
4.1. The Service may require, enable or facilitate access to or use of software or services of a third party (“Third Party”) and may be used in combination with software or services of such Third Party (the “Third Party Services”). In such case, there may be terms of use relating to the use of Third Party Services, which include any privacy policy or acceptable use policy as are applicable to you (the “Third Party Terms”). The Third Party Terms shall be deemed to include any privacy policy and acceptable use policy as are applicable to you. We may be required under or as a result of the Third Party Terms to notify you of certain terms that apply to you (either directly as an end user, or as a party whose acts or omissions could cause us to breach the Third Party Terms) when you use the Services) when you use the Service. This includes open source software terms or standard form terms of the distribution platform from which you obtain any part of the Service (e.g. Google Play Store or Apple App Store terms) which bind us as a developer or user of the distribution platform (the “Distribution Terms”). For the avoidance of doubt, insofar as this Clause 5 relates to the Distribution Terms, the relevant Distribution Terms are the terms of the specific distribution platform from which you obtained a copy of the software or application that is part of the Service. For example, if you obtained the said copy from the Google Play Store, then the relevant terms are Google’s Distribution Terms. Information on such Third Party Terms are embedded in the Service, already accounted for in these Terms of Use, publicly available (e.g. the Distribution Terms) or otherwise indicated in Schedule 1.
4.2. You are responsible for checking and reading the most updated version of all applicable Third Party Terms and you are deemed to have notice of the same. It is your responsibility to comply with the Third Party Terms. In particular, you are deemed to have notice of the Third Party Terms that we (under the Third Party Terms) are required to notify you, and you unconditionally agree to be bound by all the obligations in the Third Party Terms which are applicable to you.
4.3. If the Third Party Terms require you to enter into an agreement directly with the Third Party, it is your responsibility to enter into such agreement with the Third Party. For the avoidance of doubt:
(a) some Third Party Terms (particularly open-source terms) permit either a direct licence to you from the Third Party or a sublicence from us to you. In such cases, your licence is deemed to be a direct licence from the Third Party to you; and
(b) the terms of your agreement with the Third Party will govern your use of the relevant third party software or service, and not these Terms of Use.
4.4. If the Third Party Terms expressly or impliedly require us to incorporate certain terms in these Terms of Use (inclusive of terms which impose any minimum or maximum standards herein, and terms described in Clause 5.5 below), such terms are deemed to have been so incorporated (the “Incorporated Terms”). Examples of Incorporated Terms include provisions which require us to give you notice of certain rights and liabilities or require us to ensure that you acknowledge certain matters. Similarly, if the Third Party Terms expressly or impliedly require these Terms of Use to be altered such that the Third Party Terms are complied with, you agree that these Terms of Use shall be deemed to be so altered but only to the extent necessary for compliance.
4.5. Third Party Terms that grant the Third Party, or require us to grant the Third Party, direct rights of enforcement of these Terms of Use as a third party beneficiary, against you, are deemed to have been incorporated into these Terms of Use, and you hereby agree to grant such Third Party, such direct rights of enforcement against you.
4.6. For the avoidance of doubt, without prejudice to Clause 5.4, in relation to the access or use of software or services of a Third Party, to the extent of any inconsistency between these Terms of Use and the Third Party Terms, the latter shall prevail provided nothing in the Third Party Terms increases the liability of us beyond that stated in Clause 9.
4.7. Without prejudice and in addition to the foregoing, we shall not be responsible for your use of any software or service of a Third Party.
4.8. Unless the applicable Third Party Terms permit you to commence legal proceedings against the relevant Third Party, you shall not threaten or commence legal proceedings against a Third Party without our prior written approval.
5. Your Data
5.1. You hereby grant to us a non-exclusive, worldwide, perpetual and royalty-free right to collect, use, disclose, process, modify, adapt, create derivative works of, reproduce, and sublicense any and all information or data submitted, uploaded or shared by you to the extent necessary to provide the Service or for any other purpose expressly or impliedly provided in these Terms of Use, or as permitted by law.
5.2. You bear full responsibility for all information, data and materials (including their derivatives) which we may access or receive from you, in the course of providing the Service.
5.3. You shall ensure that you have the necessary rights to provide, upload, supply, and transmit your data to or through the Service and that your data does not contain any malicious or unauthorized code, virus, trojan horse, worm, logic bomb or other software routine or hardware components designed to permit unauthorised access, to disable, erase, or otherwise harm software, hardware or data, or to perform any such actions.
5.4. Use of the Service may require you to allow access by the Service to certain functions of the Device you use, such as push notifications, the obtaining and sharing of your location, or the collection of data from you in connection with the Service. Your use of the Service shall constitute your consent to the access by the Service of such functions of the Device you use as may be reasonably required by the Service.
5.5. You irrevocably and unconditionally waive, and shall cause to be irrevocably and unconditionally waived, all existing and future moral rights (including the right of identification) wherever in the world in respect of any information or data submitted, uploaded or shared by you (including feedback, requests or suggestions concerning the Service) to us. Such waiver shall also extend to our licensees, assigns and successors-in-title. You must also ensure that any information or data submitted, uploaded or shared by you do not infringe any moral right.
5.6. You further grant to us, and shall ensure we are granted, the right to perform malware and data scans, process, copy, or duplicate your data or metadata, code and files, only for and to the extent necessary for the purpose of providing and improving the Service.
6. Ownership of Feedback/Requests/Suggestions
6.1. You agree that all title and interest in any feedback, requests or suggestions from you to us concerning the Service shall be owned by us and, without prejudice and in addition to Clause 6.5, you shall waive all rights existing in or in respect of the same.
7. Confidentiality
7.1. If you receive information or data (in whatever form) from us or a Third Party which is designated as confidential or proprietary or is otherwise reasonably understood to be confidential or proprietary (collectively, “Confidential Information”), you must not use, disclose or reproduce the Confidential Information except for the purpose for which it was provided to you, unless you have obtained our prior written consent or that of the Third Party (as the case may be). If consent to disclose the Confidential Information to a third party is given by us or the Third Party to you, any act or omission in respect of the Confidential Information by the person receiving such Confidential Information shall be deemed to be your act or omission and you agree to be fully liable for the same. In all cases, you must protect Confidential Information to the same extent you protect your own confidential information but in no event less than a reasonable standard of care, to prevent any unauthorised access to Confidential Information. You must ensure that any recipients to whom Confidential Information is made available comply with the obligations contained in this Clause 8.
7.2. You must destroy any Confidential Information immediately upon request by us or the Third Party.
7.3. You shall not be liable for disclosure of Confidential Information in the event and to the extent any Confidential Information is required to be disclosed by you pursuant to any applicable law, regulations or directives of any relevant government, statutory or regulatory body or pursuant to any legal process issued by any court or tribunal of competent jurisdiction, provided that you must, to the extent practicably possible and permissible by law or regulations, give us or the Third Party prompt and prior notice of any such requirement and must cooperate with us or the Third Party to limit the scope of such disclosure to the maximum extent legally possible.
7.4. If you have reasonable grounds to suspect the unauthorised use, access, disclosure or reproduction of Confidential Information, you must immediately notify us or the Third Party of the same and cooperate at your own cost to limit the extent and impact of such breach.
7.5. Nothing in this Clause 8 shall prejudice our or the Third Party’s other rights at law, or under the Third Party Terms.
8. Disclaimers and Indemnity
8.1. The Service and any output of the Service are provided on an “as is” and “as available” basis without warranties of any kind. To the fullest extent permitted by law, we do not make any representations or warranties of any kind whatsoever in relation to the Service, its output or Content and hereby disclaim all express, implied and statutory warranties of any kind to you or any third party, whether arising from usage or custom or trade or by operation of law or otherwise, including but not limited to any representations or warranties:

8.5. You must not rely on any part of the Service, its output or Content to claim or assert any form of legitimate expectation against us, whether or not arising out of or in connection with our roles and functions as a public authority. We shall have no responsibility or liability to you or any third party arising out of or in connection with any fraud, phishing, or any other illegal act or omission by other parties in relation to the Service and it is your own responsibility to ensure that the Service you are using or accessing is from a legitimate source. The Service may provide output that does not represent the Government’s or our views.
8.6. You unconditionally and irrevocably undertake to defend and indemnify us and our officers, employees, agents and contractors, and to hold us and our officers, employees, agents and contractors harmless, against all liabilities, Losses, damages, costs or expenses (including legal costs on an indemnity basis) howsoever arising out of or in connection with your access or use of the Service or its output or Content, your access or use of any service provided by a Third Party, your non-compliance with these Terms of Use, Third Party Terms or Incorporated Terms, any harm or damage caused by you to any third party, and/or any contravention of any applicable laws, regulations or guidelines, whether or not you had been advised or informed of the nature or extent of such liabilities, losses, damages, costs or expenses. You warrant and represent that your access or use of the Service, its output and/or Content does not and will not breach or violate any laws, regulations, trade, economic or export sanctions (wherever in the world) applicable to you, and that you must not use or transmit in any way, any software or material that contains, or which you have reason to suspect contains, viruses, damaging components, any malicious code, illegal, infringing or undesirable content or materials to us or our agents or any Third Party.
8.7. We shall have the right to take any and all necessary actions or omissions to protect our interests, including complying with any legal requirements (such as taking down, disabling and disabling access to, removing (permanently or temporarily), and restoring (including restoring access to) any materials contained in, accessed through, uploaded to, or made available via the Service in response to any take-down or restoration notices). You agree that we are not obliged to determine the merits of any take-down or restoration notices. You further waive any rights arising as a result of the actions or omissions taken by us.

(b) operate so as to bar the enforcement or exercise of the Remedy, or of any other such Remedy in any other instance.
17.2. No waiver by us of any breach of these Terms of Use by you shall be deemed to be a waiver of any other or of any subsequent breach.

Should we fail to make the election to have the Dispute referred to arbitration within thirty (30) days of the receipt of the written notice, the Dispute shall be resolved by the Courts of the Republic of Singapore.
21.5. We may, at our sole discretion, refer any Dispute to arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the SIAC for the time being in force (“SIAC Rules”), which rules are deemed to be incorporated by reference into this Clause. Further:
(a) The seat of the arbitration shall be Singapore.
(b) The tribunal shall consist of one (1) arbitrator.
(c) The language of the arbitration shall be English.
(d) This arbitration agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore.
21.6. Notwithstanding anything to the contrary, we shall have the right to seek interim, provisional, injunctive or conservatory relief in any court of jurisdiction (including without limitation relief in respect of its intellectual property rights or rights of confidentiality).
21.7. Any reference to arbitration under this Clause 21 shall be a submission to arbitration within the meaning of the Arbitration Act 2001 for the time being in force. The application of Part II of the International Arbitration Act 1994, and the Model Law referred thereto, to this Agreement is hereby expressly excluded.
21.8. We shall have the right to discontinue or suspend provision of any part of these Terms of Use, this Service, its output, the Content, or any related services, software, data or other materials provided by us and its performance under these Terms of Use until any Dispute is settled or resolved in accordance with this Clause 21.
Schedule 1
1. Name of Service: AntiScam Pango
1.1. AntiScam Pango is a mobile application which, when enabled by you on your Device, applies artificial intelligence models running locally on your Device to assess messages received by you through supported third party messaging applications, and which generates notifications alerting you where the Service assesses that a message or conversation exhibits characteristics consistent with known scam approaches (each, an "Alert").
1.2. The Service may also enable you to submit a report of a suspected scam message or conversation through such reporting channels as we may make available through the Service from time to time. The recipients of such reports are set out in the Privacy Statement.
2. Nature of Service
2.1. The Service facilitates the identification by you of messages and conversations which may be fraudulent, by generating Alerts on your Device and by enabling you to submit reports of suspected scams to the relevant authorities. The Service is informational in nature and does not block, intercept, delete, quarantine or respond to any message.
3. Third Party Services
Name of Third Party Software/Services and Hyperlinks to Terms
3A. Modification notice
3A.1. The Service uses certain Third Party models listed in paragraph 3 of this Schedule, individually or in combination. The Authority may modify any such model, including by fine-tuning it on the Authority's scam message dataset or for scam classification, and by quantising it for on-device inference. Where the weights of a model used in the Service differ from those published by the relevant Third Party, those weights have been modified by the Authority. The models comprised in the Service, the manner in which they are combined, and any modifications made to them may be updated from time to time.
4. Special Terms
4.1. Experimental and beta Service. You acknowledge and agree that the Service is made available on an experimental and beta basis for the purposes of evaluation and testing, that the Service may contain errors and defects, and that we are under no obligation to make the Service or any part or feature of the Service generally available or to incorporate the same into any other service.
4.2. No warranty of detection. You acknowledge and agree that:
(a) the Service will not detect all scam messages or conversations;
(b) the Service can only analyse a message in respect of which a notification is received from a supported third party messaging application, and accordingly will not detect or analyse any message which does not generate such a notification, including where you are viewing the relevant conversation at the time the message is received;
(c) the Service may generate an Alert in respect of a message or conversation which is not fraudulent;
(d) the absence of an Alert is not, and must not be relied upon by you as, an indication that a message or conversation is legitimate, safe or free from risk;
(e) the Service is an aid to, and not a substitute for, the exercise of your own judgement and vigilance;
(f) no Alert or other output of the Service constitutes financial, legal or law enforcement advice, or any representation by us as to the identity, intention or conduct of any person; and
(g) you remain solely responsible for any decision made, or action taken or not taken, by you in reliance on the Service, its output or Content.
4.3. Access to messages and Device functions. You acknowledge that the Service requires you to grant notification access permission on your Device, and may request access to your contacts and permission to display over other applications. In reliance on such permissions the Service will access and process the contents of messages received by you through supported third party messaging applications, and may access your contact list for the purpose of determining whether a sender is known to you. Before the Service begins processing your messages, you will be asked to provide your explicit consent to such access and processing through the onboarding flow of the Service. You may withdraw such consent and permissions at any time through the settings of your Device, whereupon the Service may cease to function in whole or in part.
4.4. Data of other persons. Where you elect to submit a report, feedback or other content through the Service, you must ensure that you have all necessary rights and consents in respect of any message, conversation or other data of any other person included in such submission. You must not enable or use the Service on a Device used by any other person without that person's knowledge and consent.
4.5. On-device processing. The contents of messages accessed by the Service are processed locally on your Device and are not transmitted to us, save where
(a) you elect to submit a report, feedback or other content through the Service; or
(b) as otherwise set out in the Privacy Statement.
4.6. Additional restrictions. Without prejudice and in addition to Clause 3.3, you must not use the Service, or its output, to develop, test, refine or evaluate any message, script, model or system for the purpose of evading detection by the Service or by any other scam detection system, nor extract, copy, export or otherwise attempt to derive any model, model weights, parameters, training data, detection rules or thresholds comprised in the Service.
4.7. Third party messaging applications. The Service operates only in respect of the third party messaging applications specified at https://www.pango.gov.sg/faq/about-the-app/#577860741d6940f917e58254a1fd102c (opens in new tab), as may be updated by us from time to time. The Service is not affiliated with, endorsed by, sponsored by or otherwise connected with any such application or its provider, and any name or mark of any such application is used solely for the purpose of identification. The operation of the Service depends on such applications and may be impaired, interrupted or cease at any time as a result of changes made by their providers, and we shall not be liable for the same.
4.8. Eligibility and compatibility. The Service is available only for use on Devices running Android 8.0 (API level 26) and above, and requires Google Play services. Installation requires approximately 124 MB of storage, excluding message history and other data stored by the Service on your Device over time. Certain features, including enhanced scanning, require a separate download of additional components through Google Play and a Device meeting higher hardware requirements, and may not be available on all Devices. The Service requires you to grant notification access permission; without it, the Service cannot detect messages. The Service may consume battery and other Device resources.
4.9. Gemma. Features of the Service that use Gemma, including enhanced scanning, are subject to the Gemma Terms of Use, including the Gemma Prohibited Use Policy, available at https://ai.google.dev/gemma/terms (opens in new tab).
